Sadly, the burglar could not be identified and reports were made to both the D'Aman Crimson Security as well as to the Police. Our Resident Association President, Mr PJ Tan, managed to speak to the victim and he would like to take this opportunity to pre-alert all car owners not to leave any valuables, briefcases or "presumed" valuables to avoid any car break-ins. Common Property Act [Act 663] by Lembaga Perumahan Dan Hartanah Selangor</title><content type='html'>Dear Owners of &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_0"&gt;D'aman&lt;/span&gt; Crimson&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;div align="justify"&gt;As we all know, jointly appointed proxy who are the co-owners has been rejected by the developer to cast their vote in the 1st &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_1"&gt;AGM&lt;/span&gt; of &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_2"&gt;JMB&lt;/span&gt; which held on 30&lt;span class="blsp-spelling-error" id="SPELLING_ERROR_3"&gt;th&lt;/span&gt; Oct 2008. The said meeting has been &lt;span class="blsp-spelling-corrected" id="SPELLING_ERROR_4"&gt;adjourned&lt;/span&gt; thanks to the strong objection from the joint purchasers. Sec6(5) of the Building and Common Property (Maintenance and Management) [Act 663] was "unfairly" &lt;span class="blsp-spelling-corrected" id="SPELLING_ERROR_5"&gt;interpreted&lt;/span&gt; by the Developer (in joint purchasers' point of view) that the jointly appointed proxy MUST be a 3rd party. &lt;/div&gt;&lt;br /&gt;&lt;br /&gt;&lt;p align="justify"&gt;&lt;span class="blsp-spelling-error" id="SPELLING_ERROR_6"&gt;D'aman&lt;/span&gt; Crimson Owners Association ("&lt;span class="blsp-spelling-error" id="SPELLING_ERROR_7"&gt;DCOA&lt;/span&gt; or &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_8"&gt;PPDC&lt;/span&gt;") has received an official complaint from few joint purchasers (in fact, a police report has been lodged on the above incident by the Joint purchasers). &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_9"&gt;DCOA&lt;/span&gt; had taken prompt action and a letter from &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_10"&gt;DCOA&lt;/span&gt; dated 10&lt;span class="blsp-spelling-error" id="SPELLING_ERROR_11"&gt;th&lt;/span&gt; November 2008 had been given to the Commission of Building and all relevant authorities.&lt;/p&gt;&lt;br /&gt;&lt;p align="justify"&gt;According to &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_12"&gt;DCOA&lt;/span&gt; representative, we have now received a letter from &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_13"&gt;Selangor&lt;/span&gt; Housing and Property Board dated 25&lt;span class="blsp-spelling-error" id="SPELLING_ERROR_14"&gt;th&lt;/span&gt; November 2008 to COB stated their view of the above Section. The following letters which has been translated into English for your reading pleasures.... &lt;/p&gt;&lt;br /&gt;&lt;br /&gt;&lt;p align="justify"&gt;&lt;span style="color:#3333ff;"&gt;&lt;em&gt;&lt;strong&gt;Translation of the letter from &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_15"&gt;Lembaga&lt;/span&gt; &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_16"&gt;Perumahan&lt;/span&gt; &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_17"&gt;dan&lt;/span&gt; &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_18"&gt;Hartanah&lt;/span&gt; &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_19"&gt;Selangor&lt;/span&gt; (“&lt;span class="blsp-spelling-error" id="SPELLING_ERROR_20"&gt;Selangor&lt;/span&gt; Housing &amp;amp; Property Board”) to &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_21"&gt;Pesuruhjaya&lt;/span&gt; &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_22"&gt;Bangunan&lt;/span&gt; &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_23"&gt;MBPJ&lt;/span&gt; (“COB”) dated 25 November 2008&lt;br /&gt;&lt;/strong&gt;____________________________________________________________________&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#3333ff;"&gt;&lt;em&gt;&lt;br /&gt;&lt;br /&gt;ESTABLISHMENT OF JOINT MANAGEMENT BODY FOR D’&lt;span class="blsp-spelling-error" id="SPELLING_ERROR_24"&gt;AMAN&lt;/span&gt; CRIMSON APARTMENT&lt;br /&gt;DEVELOPER : CRIMSON COMMERCIAL PARK &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_25"&gt;SDN&lt;/span&gt; &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_26"&gt;BHD&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;I refer to the above matter.&lt;br /&gt;&lt;br /&gt;2. This administration following the letter from &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_27"&gt;PPDC&lt;/span&gt;, &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_28"&gt;Petaling&lt;/span&gt; &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_29"&gt;Jaya&lt;/span&gt; dated 10.11.08, was made aware of the complaint regarding the 1st Joint Management Body meeting for D’&lt;span class="blsp-spelling-error" id="SPELLING_ERROR_30"&gt;aman&lt;/span&gt; Crimson Apartment as follows :-&lt;br /&gt;&lt;br /&gt;i. The developer held the 1st Joint Management Body meeting on 30.10.08 (Thursday, even though this administration deemed the said meeting as cancelled.&lt;br /&gt;ii. On 29.10.08, one day before the 1st meeting to be carried out the development with the confirmation from the COB that the eligibility of joint owners is through a 3rd party proxy. (with reference to the letter dated 29.10.2008)&lt;br /&gt;&lt;br /&gt;3. This administration refer to the provision of the Building and Common Property (Maintenance and Management) [Act 663] relating to the 1st Meeting of the Joint Management &lt;span class="blsp-spelling-corrected" id="SPELLING_ERROR_31"&gt;Body&lt;/span&gt; as follow:&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;i. Notwithstanding subsection (4), joint purchasers shall not be entitled to vote except by way of a jointly appointed proxy&lt;br /&gt;&lt;/strong&gt;&lt;br /&gt;4. Viewing Act 663 especially sub-section 6(5) Act 663 do not specify who is eligible to be appoint as proxy for joint purchaser, this administration is of the opinion that the proxy referred to in sub-section 6(5) Act 663 can be from the joint purchaser or a 3rd party &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_32"&gt;ie&lt;/span&gt; a name not a party to the SPA.&lt;br /&gt;&lt;br /&gt;5. Hence, on the appointment as a committee member of the &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_33"&gt;JMB&lt;/span&gt; only the proxy who is a joint purchaser is eligible to be a committee member. A 3rd party proxy can only vote at the 1st Joint Management Body meeting and is not eligible to be a committee member.&lt;br /&gt;&lt;br /&gt;6. Further, the said joint purchaser must have settled the maintenance charges relating to their parcel. This is in line with the provision of sub-section 6(2) of Act 663 that stipulated that members eligible to vote are those who have paid their maintenance charges.&lt;br /&gt;&lt;br /&gt;7. The main objective of Act 663 is to protect the rights and to give power to the purchaser to determine the maintenance mechanism and jointly manage the property within their development. For this reason, this administration is of the opinion the developer has to comply with sub-section 5(2) of Act 663 to have the 1st &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_34"&gt;JMB&lt;/span&gt; meeting for D’&lt;span class="blsp-spelling-error" id="SPELLING_ERROR_35"&gt;aman&lt;/span&gt; Crimson Apartment on a non-working day to enable the purchasers attend the said meeting. Other than this, it is proposed the proxy form be sent together with the notice calling the 1st meeting.&lt;br /&gt;&lt;br /&gt;8. The administration draws the attention of &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_36"&gt;YBhg&lt;/span&gt; &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_37"&gt;Dato&lt;/span&gt; the provision of sub-section 5(1) Act 663 “It shall be the duty of the developer to convene the first meeting of all purchasers.” The provision of sub-section 5(1) Act 663 do not interpret that the first meeting has to be carried out by the developer or the purchaser. Regretfully, no where in Act 663 that clearly explain the procedures of the 1st meeting. In view of this, to ensure the smooth running of the 1st meeting and the objective of the establishment of the Body is achieved, the purchasers and the developer to determine unanimously the chairman for the said first meeting.&lt;br /&gt;&lt;br /&gt;9. This administration requests the cooperation of &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_38"&gt;YBhg&lt;/span&gt; &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_39"&gt;Dato&lt;/span&gt; as Commissioner of Building for this area to appropriately advise and instruct the developer on the proceeding of the said 1st meeting. This is to ensure the purchasers of D’&lt;span class="blsp-spelling-error" id="SPELLING_ERROR_40"&gt;Aman&lt;/span&gt; Crimson Apartment obtain their rights and power as provided in Act 663.&lt;br /&gt;&lt;br /&gt;10. &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_41"&gt;YBhg&lt;/span&gt;. &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_42"&gt;Dato&lt;/span&gt;’s cooperation and early attention is appreciated.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;span class="blsp-spelling-error" id="SPELLING_ERROR_43"&gt;DATIN&lt;/span&gt; &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_44"&gt;PADUKA&lt;/span&gt; &lt;span class="blsp-spelling-error" id="SPELLING_ERROR_45"&gt;ALINAH&lt;/span&gt; AHMAD&lt;br /&gt;&lt;br /&gt;C.C. float: left;" alt="" src="http://4.bp.blogspot.com/_cGkVLtRCZ18/SMiH9g0DQXI/AAAAAAAAAEA/bVO-Co-MWyc/s320/m_02location.jpg" border="0" /&gt;&lt;/a&gt;&lt;br /&gt;&lt;br /&gt;&lt;div&gt;Thursday September 11, 2008&lt;br /&gt;&lt;strong&gt;Residents hold protest against MBPJ for causing inconvenience&lt;br /&gt;&lt;/strong&gt;Story and photos by YIP YOKE TENG &lt;/div&gt;&lt;br /&gt;&lt;br /&gt;&lt;div&gt;&lt;br /&gt;THE closure of the old tunnel linking Ara Damansara to the LDP via Taman Megahmas has resulted in a massive traffic congestion at the new tunnel near the Football Association of Selangor (FAS) building in Kelana Jaya during the peak hours.&lt;br /&gt;The old tunnel near the NiuZeXui commercial area, commonly known as the NZX tunnel, was closed since Sept 1.&lt;br /&gt;A signboard put up by the Petaling Jaya City Council (MBPJ) states that the NZX tunnel is closed until Sept 29 for a survey and study on the traffic situation.&lt;br /&gt;Bumpy ride: The road is riddled with potholes&lt;br /&gt;The chaos caused by the closure of the NZX tunnel has raised the ire of thousands of angry motorists who have to suffer great inconvenience for hours to travel just a short distance.&lt;br /&gt;Those affected most are residents of the D’Aman Crimson Condominiums, Ara Damansara and Lembah Subang and nearby areas. It is even said that business in these areas has dropped by as much as 50%.&lt;br /&gt;About 100 angry residents staged a peaceful protest last Saturday at the NZX tunnel against the MBPJ for closing the tunnel.&lt;br /&gt;The tunnel closure has brought unbearable inconvenience to more than 10,000 residents, according to the president of D’Aman Crimson Condominiums, who only wants to be identified as Tan.&lt;br /&gt;“It has forced us to take a detour of an extra 3.5km. And, to make things worse, the stretch is terribly congested during peak hours. It sometimes takes us 30 minutes just to travel the short distance from the FAS building to the LDP because the cars have to take a long pause before entering the busy highway,” he said.&lt;br /&gt;Troublesome closure: The NZX Tunnel linking Ara Damansara to LDP via Taman Megahmas has been closed since Sept 1 to facilitate a traffic study but the closure has aroused the ire of residents and motorists.&lt;br /&gt;Tan said traders were suffering the consequences of the closure as their businesses had been badly hit.&lt;br /&gt;He said that taxi drivers at the Kelana Jaya LRT stations did not want to enter the “trapped” housing estates and, if they did, they demanded higher fares.&lt;br /&gt;“Is having one tunnel better than having two? We just don’t see the logic. We want an explanation from the MBPJ on the whole fiasco,” Tan said.&lt;br /&gt;According to Ara Damansara resident Peter Tan, the residents are stranded each time it rains as the roads and tunnels would be flooded.&lt;br /&gt;Peter said that the opening of the FAS tunnel a month ago had eased traffic congestion mainly caused by the volume of vehicles coming from Shah Alam, Subang Jaya, Glenmarie and nearby areas, which used the NZX Tunnel as an alternative to the LDP.&lt;br /&gt;Angry lot: Residents showing their dissatisfaction with the tunnel closure&lt;br /&gt;“But, since the closure of the NZX tunnel, traffic jams have been transferred from Taman Megahmas to Kelana Idaman. Moreover, roads are starting to have potholes and this is worsened by the current rainy spell,” he said.&lt;br /&gt;Sunny Nah, also a resident of Ara Damansara, said that he nearly had an accident when the NZX tunnel was first closed as it was not properly barricaded then.&lt;br /&gt;“Ara Damansara has a population of at least 3,000. We are feeling the pinch of petrol increase and we will really appreciate if the local authorities are kind enough to grant us a shorter route,” Nah said.&lt;br /&gt;According to the residents, the route via the FAS tunnel has many other setbacks.&lt;br /&gt;They said the stretch was dark and dangerous. The roads are small but are frequented by many motorists and students of two schools in the vicinity.&lt;br /&gt;&lt;br /&gt;The residents also lamented that with the closure of the NZX tunnel, they were now trapped.&lt;br /&gt;They said the Ara Damansara accesses and exits had always been problematic, the three tunnels, the third being the Tropica tunnel, were often flooded while the Subang route was perpetually congested.&lt;br /&gt;“We are not rats! We don’t want to use tunnels all the time, we need proper roads,” resident K.S. Hiew said.&lt;br /&gt;The residents want the MBPJ to reopen the NZX tunnel pending the construction of proper roads to their areas.&lt;br /&gt;Aloysius Francis Pinto, an aide to Subang MP R. MAK&lt;br /&gt;&lt;a href="mailto:kwmak@thestar.com.my"&gt;kwmak@thestar.com.my&lt;/a&gt;&lt;br /&gt;&lt;br /&gt;&lt;div align="justify"&gt;Condominiums are a statement of luxury, but behind the facade, residents complain of the lack of services from their management companies (MCs) while MCs complain that the residents who refuse to pay management fees are the ones preventing such services from being provided. &lt;/div&gt;&lt;div align="justify"&gt;&lt;br /&gt;This “chicken and egg” scenario is causing a lot of dissent among condominium property owners, so much so that a group of such affected owners decided to form the Condominium, Apartment and High-rise Committee (CAHC) to champion the rights of condominium owners.&lt;br /&gt;There are no quick fixes to the problems, however, as residents who got together to fight their issues discover numerous hurdles and obstacles before them.&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;“There is a lack of transparency in the way things are done presently and residents are tired of being taken for a ride,” said CAHC pro tem chairman Tengku Nazaruddin Zainuddin.&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;Arguments between residents and MCs are often the result of money matters. Residents are already paying a premium on their service charges and when such services are not up to expectations, complaints would ensue.&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;Most MCs do not make the matter any easier to resolve because they do not allow the management accounts and the sinking fund accounts to be viewed, citing excuses that the accounts could not be shown.&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;“Don’t let them cheat you. Withholding such accounts from residents is a violation of the Housing and Development (Control and Licensing) Act 1966 that many MCs and condominium owners themselves are not aware of,” said CAHC pro tem assistant chairman Khong Chee Seng.&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;&lt;u&gt;Section 19&lt;/u&gt; of the Act states that the developer shall provide the purchaser with a copy of the Annual Audited Accounts for the expenses incurred for the provision of the said services.&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;&lt;u&gt;Section 20&lt;/u&gt; (sub-clauses 3 and 4) meanwhile provides for the Sinking Fund accounts to be made available to the purchaser.&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;CAHC through the residents associations has used this Act to apply for the accounts from two MCs of condominiums located in Petaling Jaya and Klang. However, they have yet to provide a copy to owners.&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;Part of the reason MCs do not want to disclose their accounts is the fact that some of them charge management fees illegally.&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;Prior to the acquisition of the strata title, the developer is either supposed to manage the condominium or outsource the management to another person or corporation.&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;“Any person who undertakes property management practice is required by law to register with the Board of Valuers, Appraisers and Estate Agents,” said Board of Valuers, Appraisers and Estate Agents registrar R. Mahaletchumi in reply to a query on management fee charges.&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;“Nevertheless, if the condominium concerned has not been issued with strata titles, then the developer may manage the condo himself, provided he does not charge property management fees.”&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;The right to charge such fees lies with those registered with the Board, as stated in Section 21 of the Valuers, Appraisers and Estate Agents Act 1981.&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;Developers who outsource the management to a third party must ensure that the person or company is registered with the Board.&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;Monday January 8, 2007&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;&lt;strong&gt;Strong-armed tactics used to bully residents&lt;br /&gt;&lt;/strong&gt;&lt;/div&gt;&lt;div align="justify"&gt;Condominium, Apartment and High-rise Committee (CAHC) pro tem assistant chairman Khong Chee Seng said there are many stories of management committees (MCs) using strong-armed tactics to bully residents into paying up the management fees.&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;One of the tactics employed is the clamping of water meters – a penalty which some MCs have included in the in-house rules and regulations for not paying management fees.&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;What many MCs do not take into account, however, is that Section 35 of the Strata Title Act 1985 specifically states that condo residents have the right to support, service and shelter, which includes access to water, and that any attempt to clamp water meters is in violation of the Act.&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;CAHC is trying to get around this deadlock by getting the Selangor state government to legislate a law forcing MCs to hand over the water meters to Syarikat Bekalan Air Selangor (Syabas).&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;Syabas is willing to let condominium dwellers pay domestic rates, but they must first control the meters, and they cannot take control of it presently due to the ambiguity in the law on water meters governing joint-ownership properties like condominiums.&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;Syabas has already submitted the proposal to the state government and it would take some three months for the state government to implement, if it agrees to such a suggestion.&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;Other tactics include lawyers’ letters with threats of lawsuits.&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;Khong himself has been slapped with several lawsuits amounting to RM5mil for fighting on behalf of condominium residents.&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;But residents are not the only victims here. Bungah Raya Management Corporation secretary Somasundaram Venkates-waran said from his experience, MCs use water clamping to enforce payment of arrears by defaulters.&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;“Though this is certainly not a fair thing to do (access to drinking water is a basic human right), it has been found to be a practical, cost-effective and quick recovery method,” said Venkateswaran.&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;“Legal recovery procedures are expensive and time-consuming. MCs may have to wait a long time to obtain judgment from our courts, all the more so with our appellate courts system.&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;“In the meantime, core services including corridor and car park lighting and lift operations have to be disrupted or even stopped altogether due to the lack of collections from owners. This will obviously anger owners who are good paymasters who may also stop payment until services are restored. How should these Deposit be transferred to the Individual? And, what about the differences, if any?&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;3. Is the Statement post a condition that only new meter be installed that the Domestic Rate will be applied?&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;4. With an average of 300/unit, a new Deposit of 1.62 billion will be collected, besides possible new installation Charge. Will approved meters not be used as reported (somehere)?&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;Therefore, unless the old deposits are transferred or settled with Individual owners, the move of having individual meters is only contributing another nuisance.&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;Technically, it will also posed problem when there are Filtering system between the Bulk Meter and the Individual meters.&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;CONDO RATE&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;Most Condo are required to have water pump after the Bulk Meter and a water Tank to ensure pressure of water supply to the Condo. Therefore, there is no reason of higher price than domestic. Besides, there are less piping to be used than landed properties as the Units of the Condo are more centralized&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;CAHC&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;When there should be 2,200 bulk meters, apparently, the number CAHC are representing is still a minority. Therefore, in order to avoid CAHC from being accused of manipulating the discussion, I hope CAHC committee will posted what they want to discuss with Saybas for comment before discussion (could it be done on &lt;a title="http://www.monitoringglobalisation.org" href="http://www.monitoringglobalisation.org/"&gt;http://www.monitoringglobalisation.org/&lt;/a&gt; ?) and report what had been discussed during the meeting with Saybas. Otherwise, the discussion could solve some problems but causing other loopholes.&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;Meanwhile, I SALUTE THE WORK OF CAHC FOR THEIR CONTRIBUTIONS AND HOPE THE ABOVE CAN BE ATTENDED BEFORE ANY SOLID PROPOSAL to be voted by the public. How wrong they were.&lt;br /&gt;Residents of Palm Spring Condominium woke up in the morning on Sunday to&lt;br /&gt;find their Toyota Wish, Proton Waja, Toyota Mark X and Perodua MyVi&lt;br /&gt;stolen from right under their noses.&lt;/p&gt;&lt;p&gt;They just couldn't believe the audacity of the thieves and the&lt;br /&gt;incompetence of the guards.&lt;/p&gt;&lt;p&gt;The hard-to-believe thefts took place despite close circuit television&lt;br /&gt;cameras (CCTV) sweeping the area.&lt;/p&gt;&lt;p&gt;Three residents lost four cars despite them being parked INSIDE the&lt;br /&gt;condominium parking bays.&lt;/p&gt;&lt;p&gt;A check by our reporter yesterday showed that residents had to key in&lt;br /&gt;their pass at the entrance to the condo and once again at parking bay&lt;br /&gt;building. They also have to do the same to exit.&lt;/p&gt;&lt;p&gt;A shocked Muhammad Nazri Noran, 31, who lost his silver metallic 1.6&lt;br /&gt;Waja, said he was disappointed with the management of the condominium&lt;br /&gt;and its security for not taking prompt action.&lt;/p&gt;&lt;p&gt;Nazri claimed that the security did not act promptly when he insisted on&lt;br /&gt;watching the recordings of the CCTV that was installed in the&lt;br /&gt;condominium's compound.&lt;/p&gt;&lt;p&gt;"We were told to wait while they figure out to whether to hold a&lt;br /&gt;dialogue with the residents," said Nazri who has been staying at the&lt;br /&gt;condo for three years.&lt;/p&gt;&lt;p&gt;Nazri said he was dumbfounded when the security guards did not check the&lt;br /&gt;vehicles that went in and out of the condominium in the wee hours.&lt;/p&gt;&lt;p&gt;"The thieves who stole our cars managed to get into our condominium&lt;br /&gt;using keycards. We want to question the management how the thieves got&lt;br /&gt;the keycards."&lt;/p&gt;&lt;p&gt;Nazri, who added that the security services for the condominium keep&lt;br /&gt;changing, said: "Since early this year the security company has been&lt;br /&gt;changed three times as their uniforms were not the same each time."&lt;/p&gt;&lt;p&gt;Nazri's wife Roseliza Hussein said she couldn't believe her ears when&lt;br /&gt;told by the condominium's security that the CCTV was malfunctioning.&lt;/p&gt;&lt;p&gt;"When we went to the CCTV control room, the security told us that they&lt;br /&gt;could view the areas in the condominium through the CCTV but was unable&lt;br /&gt;to make any recording as the device was faulty.&lt;/p&gt;&lt;p&gt;"We were told the CCTV was in such state more than a month ago and they&lt;br /&gt;(security) had informed the management about it,"&lt;/p&gt;&lt;p&gt;Newlywed Melayziaty Anas Chan, 27, found it hard to accept the fact that&lt;br /&gt;her four-month-old Toyota Wish was stolen in such a manner.&lt;/p&gt;&lt;p&gt;"My husband was surprised to find my car missing from my parking spot.&lt;br /&gt;The thieves smashed my car window.&lt;/p&gt;&lt;p&gt;Melayziaty said also missing were several hundred invitation cards in&lt;br /&gt;the stolen car. She and her husband Theo Philus had planned to mail&lt;br /&gt;several hundred invitation cards to guests for their wedding ceremony.&lt;/p&gt;&lt;p&gt;Businessman Chew Yew Fong, 43, lost a Toyota Mark X worth about&lt;br /&gt;RM215,000 and a Perodua MyVi (belonging to his wife).&lt;/p&gt;&lt;p&gt;"I wanted to go for breakfast with my family but we were shocked to see&lt;br /&gt;both our vehicles missing. The management should be more responsible in&lt;br /&gt;keeping this area safe," he said. The victims lodged reports at the Kota&lt;br /&gt;Damansara police station.&lt;/p&gt;&lt;p&gt;A manager of the Palm Spring Joint Management Committee, who only wants&lt;br /&gt;to be identify as Ng, said they have installed a total of 40 CCTVs in&lt;br /&gt;the condominium compund and they are working properly.&lt;/p&gt;&lt;p&gt;"Our CCTVs are in working order. These phrases best describe the common condition that most tunnels in Petaling Jaya are in and to make matters worse, some of them have become the main cause of traffic congestion defeating the main purpose that they were built for.&lt;/p&gt;&lt;p&gt;While some tunnels in Petaling Jaya, including the one along Persiaran Surian and the Damansara-Puchong Highway (LDP) tunnel at Damansara Utama have been well maintained by the highway concessionaires, other tunnels especially in residential areas are in bad shape without proper management.&lt;/p&gt;&lt;div class="story_image right" style="width: 214px;"&gt;&lt;img alt="" src="http://thestar.com.my/archives/2008/7/21/central/m_pg02emas.jpg" height="288" width="200" /&gt; &lt;span class="caption"&gt;&lt;b&gt;Danger lurking:&lt;/b&gt; The tunnel in Jalan Emas 2 is a dangerous spot with high tension cables exposed, posing a risk to motorists.&lt;/span&gt; &lt;/div&gt;&lt;p&gt;A check by &lt;i&gt;StarMetro&lt;/i&gt; reveals that some of these tunnels are illegal because they do not adhere to building specifications and should be closed to traffic.&lt;/p&gt;&lt;p&gt;According to the Petaling Jaya City Council (MBPJ), the building specifications of tunnels in the city are in accordance to the requirements of Public Works Department (JKR). The engineering department of MBPJ is responsible for issues pertaining to tunnels.&lt;/p&gt;&lt;p&gt;“The general guideline is that a tunnel must be 3.65m in height and 9.7m in width, inclusive of walkway. The width was previously set at 9m,” said MBPJ public relations director Haniza Abdul Hamid.&lt;/p&gt;&lt;p&gt;The engineering guidelines provide for a comfortable one-lane access for vehicles unlike the current tunnels now which is usually too narrow, making them accident-prone.&lt;/p&gt;&lt;p&gt;“Maintenance and upgrading is carried out when required. Cases of vandalism are common and we need cooperation from the public. They should lodge reports with us so that we can take the necessary steps,” Haniza explained.&lt;/p&gt;&lt;p&gt;This is in response to the escalating reports of theft and vandalism where light bulbs in many tunnels are stolen as well as the high-tension cables which are stolen for their copper.&lt;/p&gt;&lt;p&gt;&lt;b&gt;What tunnels are for&lt;/b&gt;&lt;/p&gt;&lt;p&gt;Tunnels in PJ are also mainly built to provide an alternative route below highways and this means that most of the tunnels are constructed on low land. This has caused the tunnels to flood especially during heavy rain, posing danger to motorists.&lt;/p&gt;&lt;p&gt;But the fact is most of these tunnels have remained as detour routes for motorists.&lt;/p&gt;&lt;p&gt;“I think most tunnels serve as an easy access between two areas or two roads which otherwise would require the motorists to go a longer way to do a U-turn or cross junctions to get to the other side.&lt;/p&gt;&lt;p&gt;“It is a short-term solution but keeping the tunnels open without proper traffic planning will ultimately affect traffic flow and cause congestion,” said engineer Syed Rizal, who lives in Damansara Perdana.&lt;/p&gt;&lt;p&gt;Most residents in Damansara Perdana now have to use the tunnel access at the area’s traffic light junction to get on the LDP leading to Bandar Utama or Taman Tun Dr Ismail.&lt;/p&gt;&lt;p&gt;If that tunnel is closed, the residents will have to do a detour across Mutiara Damansara or U-turn at the Kepong LDP toll.&lt;/p&gt;&lt;p&gt;“Some tunnels should be kept open if sufficient traffic study is done to show that it will alleviate congestion and not just to provide convenience for motorists.&lt;/p&gt;&lt;p&gt;“I also believe that the local authority should be more mindful in managing the tunnels because most of the time, the lightings are not working and it is dangerous,” Rizal said.&lt;/p&gt;&lt;div class="story_image center" style="width: 384px;"&gt;&lt;img alt="" src="http://thestar.com.my/archives/2008/7/21/central/m_pg02tropicana.jpg" height="272" width="370" /&gt; &lt;span class="caption"&gt;&lt;b&gt;Kicker:&lt;/b&gt; This tunnel in Tropicana provides easy access for the residents of Tropicana Golf and Country Homes to get to LDP.&lt;/span&gt; &lt;/div&gt;&lt;p&gt;&lt;b&gt;Fast solution sought in Ara Damansara&lt;/b&gt;&lt;/p&gt;&lt;p&gt;In Ara Damansara, the traffic problem is brewing and residents are desperate for the local authority to find a solution soon.&lt;/p&gt;&lt;p&gt;The main cause is the access of Ara Damansara to the LDP and one tunnel cuts through Jalan Emas 2 is the main access that almost all the residents in Ara Damansara are using.&lt;/p&gt;&lt;p&gt;The tunnel was initially built as a shortcut for rubbish trucks and not for commercial vehicles. It currently serves as a toll-free alternative between Ara Damansara and the LDP.&lt;/p&gt;&lt;p&gt;However, the increasing density of Ara Damansara has amounted to high traffic during peak hours and the tunnel has become a nightmare for surrounding residents and motorists.&lt;/p&gt;&lt;p&gt;The condition of the tunnel has been in bad shape with potholes, high-tension cables hanging, and even the gantry has been stolen allowing access to heavy-duty vehicles like construction lorries.&lt;/p&gt;&lt;p&gt;Residents have also reported car break-ins as the tunnel provided an easy getaway for thieves.&lt;/p&gt;&lt;p&gt;MBPJ is now undertaking a traffic study on the current situation in Ara Damansara which also involves another nearby tunnel which cuts through Kelana Idaman to the Selangor Football Association (FAS) field.&lt;/p&gt;&lt;div class="story_image center" style="width: 414px;"&gt;&lt;img alt="" src="http://thestar.com.my/archives/2008/7/21/central/m_pg03ismail.jpg" height="268" width="400" /&gt; &lt;span class="caption"&gt;&lt;b&gt;Cutting through:&lt;/b&gt; The Damansara Perdana tunnel is a convenient access way for residents heading to Bandar Utama or Taman Tun Dr Ismail.&lt;/span&gt; &lt;/div&gt;&lt;p&gt;The FAS tunnel is now closed despite being completed for almost half a year and would have been a solution to help divert traffic from the Jalan Emas 2 tunnel.&lt;/p&gt;&lt;p&gt;“We have received a lot of responses from the residents and will begin our traffic study on July 21 (today) where we will open the FAS tunnel.&lt;/p&gt;&lt;p&gt;“We want to see how the traffic patterns will be once the other tunnel is open so we can think of a long-term solution for this problem,” said a spokesman from the MBPJ’s engineering department.&lt;/p&gt;&lt;p&gt;MBPJ will embark on a continuous assessment on the sustainability of tunnels in PJ but they cite that the responses of residents are of importance.&lt;/p&gt;&lt;p&gt;“There will be residents who will oppose the idea but traffic study is something that we need to do to come up with a sustainable solution. They are:&lt;br /&gt;&lt;br /&gt;* The 10 per cent hike in assessment fees on residents in 2006.&lt;br /&gt;&lt;br /&gt;* MBPJ's gazzetted account amounting to millions which also includes uncollected assessment fees. To date no figures have been made public.&lt;br /&gt;&lt;br /&gt;* The accounts of the MBPJ's football club funds after the club was closed in 2007.&lt;br /&gt;&lt;br /&gt;* The number of illegal billboards around PJ.&lt;br /&gt;&lt;br /&gt;* The privatisation of car parks in PJ to a company called Godell.&lt;br /&gt;&lt;br /&gt;Liew has appealed to PJ residents to join APAC. The membership registration fee is RM10 and the yearly subscription RM50.&lt;br /&gt;&lt;br /&gt;PJ residents with relevant problems are urged to call or e-mail any one of the committee members.&lt;br /&gt;&lt;br /&gt;Under APAC is the Condominium Apartment and High Rise Building (CAAC) unit, of which the chairman is Tengku Nazaruddin Tengku Zainudin.&lt;br /&gt;&lt;br /&gt;"We have 60 condos and high-rise buildings around PJ. Our focus is on the issues related to the welfare of the residents of these buildings," said Nazaruddin.&lt;br /&gt;&lt;br /&gt;Meanwhile, Ho Fook Chuan, a resident of Flora Damansara, Damansara Perdana, said he is frustrated by the long-delay in the formation of the Joint Management Bodies (JMB). Talks in setting up JMB have been underway since April.&lt;br /&gt;&lt;br /&gt;JMB is a body that would officially link the management offices of high-rise buildings with MBPJ in resolving problems faced by the residents.&lt;br /&gt;&lt;br /&gt;"The local authorities do not seem to be serious about this. With as little as RM7, you can travel almost anywhere on Klang Valley’s RapidKL’s buses and light rail transit for the whole day. With a monthly pass for RM135 – just a little more than a full tank of petrol for a Proton Wira – your month’s transport needs should be taken care of. The cost should be lower in other parts of the country.&lt;/p&gt;&lt;p&gt;But of course, the current state of our public transport obviously cannot take care of anyone’s needs satisfactorily.&lt;/p&gt;&lt;p&gt;Unreliable buses and trains, sardine-packed LRTs, delayed buses because of traffic jams, safety concerns and a host of other negative issues make public transport hardly desirable as an alternative to private cars.&lt;/p&gt;&lt;p&gt;Here are some crucial improvements needed before public transport can become a true option for people.&lt;/p&gt;&lt;p&gt;&lt;b&gt;1. More trains and buses&lt;/b&gt;&lt;/p&gt;&lt;p&gt;It is as basic as this! Not only will service become more reliable, more trains and buses will make public transport less packed and more attractive.&lt;/p&gt;&lt;p&gt;No one, especially women, will trade the comfort of a car for a situation where one is pressed all over by other humans in a train, even if it costs more.&lt;/p&gt;&lt;p&gt;Promises were made for more LRT vehicles and buses under the RapidKL and Rapid Penang regimes. How much longer do we have to wait?&lt;/p&gt;&lt;p&gt;&lt;b&gt;2. Get the new lines going&lt;/b&gt;&lt;/p&gt;&lt;p&gt;The new Damansara-Cheras LRT line, as well as the Subang Jaya and Puchong extensions, were announced by Deputy Prime Minister Datuk Seri Najib Tun Razak in 2006. Till today, we have not heard about when work will start.&lt;/p&gt;&lt;p&gt;We do not even know where they will run. It is crucial to also think beyond these new lines.&lt;/p&gt;&lt;p&gt;Singapore already knows where its new Mass Rapid Transit lines will run in 2020.&lt;/p&gt;&lt;p&gt;&lt;b&gt;3. Cash for maintenance&lt;/b&gt;&lt;/p&gt;&lt;p&gt;The KTM Komuter, after running for 13 years, is now suffering from years of “postponing” maintenance due to funding issues. The LRT system is about 10 years old now, which is about the right time for an overhaul.&lt;/p&gt;&lt;p&gt;RapidKL is also facing issues with keeping its buses on the road because of breakdowns. Other private companies can hardly afford regular maintenance, what more, overhauling. The Government must come to their aid.&lt;/p&gt;&lt;p&gt;Get the allocations disbursed quickly, get the tenders out without delay and pick the correct people to do the work. Remember, keeping enough buses on the road is not just about buying new buses. It is about keeping the existing ones in working condition.&lt;/p&gt;&lt;p&gt;&lt;b&gt;4. Low fares through subsidies&lt;/b&gt;&lt;/p&gt;&lt;p&gt;Low fares are crucial, especially when we are putting the case for public transport in the context of rising living costs. Most people who rely on public transport cannot afford any other means of travel.&lt;/p&gt;&lt;p&gt;If there is a group of people who should benefit from subsidies, this should be the one. Subsidies can come from taxing private car users – either through road tax or road pricing. The World Bank says that private car users are generally “undercharged” for using urban roads and for their impact on the environment.&lt;/p&gt;&lt;p&gt;&lt;b&gt;5. One or two companies enough&lt;/b&gt;&lt;/p&gt;&lt;p&gt;Competition in public transport is not about having many companies running the same route, it is about competing for the right to run on a particular route.&lt;/p&gt;&lt;p&gt;An operator is selected on the basis of being most able to satisfy the requirements of commuters and other parties (reliable service, safe buses, lowest subsidy) and once selected, it should enjoy a monopoly of the route.&lt;/p&gt;&lt;p&gt;The Government will have to regulate to ensure service is up to the mark. The benchmark should be the best-run route in the system.&lt;/p&gt;&lt;b&gt;&lt;/b&gt;&lt;p&gt;&lt;b&gt;6. One regulatory authority&lt;/b&gt;&lt;/p&gt;&lt;p&gt;It is a case of too many cooks spoiling the broth, as each cook has his own ideas and conflicting interests. Now, 13 government departments and agencies have a say in public transport.&lt;/p&gt;&lt;p&gt;There should just be one to plan the system, dish out the permits (to control the number of operators), organise the routes (to curb duplication) and ensure that the trains and buses run according to time.&lt;/p&gt;&lt;p&gt;It should also be the one dishing out subsidies. The single authority should have only one objective and no other – to ensure that the public gets good public transport.&lt;/p&gt;&lt;p&gt;&lt;b&gt;7. Bus lanes and other facilities&lt;/b&gt;&lt;/p&gt;&lt;p&gt;Buses should have their own “track” so that they can be faster than private cars. That is the only way public transport can be more attractive than cars.&lt;/p&gt;&lt;p&gt;Modern bus lanes such as those in Curitiba, Brazil, and Jakarta – where they are virtually separate special roads just for buses – have made bus transport a success. And don’t worry if road users complain. The one lane taken away from them is making the movement of thousands of people more efficient. Bus lanes are also cheaper than train systems and can be just as efficient.&lt;/p&gt;&lt;p&gt;&lt;b&gt;8. Ensure safety of passengers&lt;/b&gt;&lt;/p&gt;&lt;p&gt;It should be a basic right of commuters to be able to travel safely. An unsafe system will only turn people away.&lt;/p&gt;&lt;p&gt;&lt;b&gt;9. Good customer information&lt;/b&gt;&lt;/p&gt;&lt;p&gt;There is no point in having hundreds of beautiful buses on the road without commuters knowing where they are going. Many rather drive than take buses because they are in control of their journey. The more people know how the system works, the more they will use the system.&lt;/p&gt;&lt;p&gt;&lt;b&gt;10. Please walk the talk&lt;/b&gt;&lt;/p&gt;&lt;p&gt;All the above initiatives and problems have been recognised, considered and studied. Announcements are regularly made of moves to improve the system. Yet this comment still has to be written in such a tone. The rate is more than double," she said.&lt;br /&gt;&lt;br /&gt;Thein declined to detail reasons behind the delay in converting all the apartments into individual accounts, but stressed that Syabas was more than willing to facilitate the conversion.&lt;br /&gt;&lt;br /&gt;"We have publicised the fact that we want apartment residents to have their own accounts with us. The only material we have is from the House Buyers Association, but it's not really enough."&lt;br /&gt;&lt;br /&gt;"There are many pitfalls during this transition period," says Chang Kim Loong, honorary secretary-general of the national HBA, "But no one's looking out for the consumers."&lt;br /&gt;&lt;br /&gt;Thousands of joint management bodies (JMBs) were supposed to have been set up this year, giving owners of flats, apartments and condominiums a say, together with developers, in how subdivided properties are run.&lt;br /&gt;&lt;br /&gt;JMBs are interim bodies for the years before strata titles are issued and owners' management corporations (MCs) set up to take over from developers.&lt;br /&gt;&lt;br /&gt;One of their biggest responsibilities will be to appoint someone to manage their common property, from the grounds and lifts to corridor lighting and swimming pools.&lt;br /&gt;&lt;br /&gt;Almost overnight, a huge and lucrative industry has opened up.&lt;br /&gt;&lt;br /&gt;"If unit owners paid an average of RM50 in monthly maintenance charges, it would mean RM50 million a month, RM600 million a year," says Kumar Tharmalingam, secretary-general of the International Real Estate Federation (Fiabci), in Asia Pacific.&lt;br /&gt;&lt;br /&gt;The Board of Valuers, a statutory regulator, says owners should appoint only property managers that it has registered. But a lobby group, the VAEA Joint Action Group, insists that there is no such restriction.&lt;br /&gt;&lt;br /&gt;The VAEA refers to the Valuers, Appraisers and Estate Agents Act 1981, the statute that governs the board.&lt;br /&gt;&lt;br /&gt;The Joint Action Group has players from different industries as members, ranging from the Real Estate and Housing Developers Association (Rehda) to apartment management corporations and the Associated Chinese Chamber of Commerce and Industry (ACCCIM). Fiabci Malaysia, which Tharmalingam used to head, is also part of the group.&lt;br /&gt;&lt;br /&gt;The group reads the law differently and asserts that by definition under two other Acts, the owner bodies and corporations escape the effects of the Valuers Act.&lt;br /&gt;&lt;br /&gt;They claim the two Acts -- the Strata Titles Act 1985 and the Building and Common Property (Maintenance and Management) Act 2007 -- allow owners' committees to appoint what they call managing agents.&lt;br /&gt;&lt;br /&gt;"Anyone with the right experience and ability can be a managing agent. JMBs and MCs can appoint any one they see fit to manage their properties," says Datuk Teo Chiang Kok, See Hoy Chan director.&lt;br /&gt;&lt;br /&gt;Their problem with the Valuers Act is that it effectively allows only registered valuers to become property managers. They say this makes the property management industry a monopoly for just a few hundred registered valuers.&lt;br /&gt;&lt;br /&gt;"But it is the free market that should decide," Teo says.&lt;br /&gt;&lt;br /&gt;Board of Valuers president Datuk Abdullah Thalith Md Thani says anyone involved in managing and maintaining property should be properly regulated and well-qualified.&lt;br /&gt;&lt;br /&gt;"I want to open up registration to anyone who is interested. It's a misunderstanding."&lt;br /&gt;&lt;br /&gt;He says he had proposed to amend the Valuers Act, but intense resistance from developers and other property players forced him to drop the matter. Thalith is president by virtue of his post of director-general of the Valuation Department under the Ministry of Finance.&lt;br /&gt;&lt;br /&gt;Thalith agrees with most industry players that the Act's provisions for regulating property managers are inadequate, and enforcement patchy.&lt;br /&gt;&lt;br /&gt;But he worries that those who appoint the so-called managing agents could be courting financial disaster arising from mistakes, negligence and dishonesty. Those registered under the Act would be required to obtain professional indemnity insurance, he points out.&lt;br /&gt;&lt;br /&gt;The HBA, a voluntary organisation which represents home owners, agrees owners are exposed even if these unregistered managing agents had adequate indemnity insurance.&lt;br /&gt;&lt;br /&gt;Chang, who is honorary secretary, argues that the insurer could repudiate liability and refuse to pay up since the managing agent is not a legitimate property manager registered with the Board of Valuers.&lt;br /&gt;&lt;br /&gt;Indeed, the same could happen to owner bodies themselves, the JMBs and MCs, he says.&lt;br /&gt;&lt;br /&gt;"The relevant statutory provisions do include prosecutions and the right to sue, but this is hardly any protection at all to owners. There are too few preventive measures." The HBA favours tighter regulation and compulsory licensing of property managers. "Lives and properties are entrusted to their care, control and management," Chang says.&lt;br /&gt;&lt;br /&gt;He also urges the board to grant amnesty to competent but unregistered property managers, to encourage them to register.&lt;br /&gt;&lt;br /&gt;"It's similar to the drive that was extended to unlicensed real estate agents some years ago."&lt;br /&gt;&lt;br /&gt;Fiabci's Tharmalingam agrees, saying the board has, by inaction, allowed unlicensed property managers to flourish for 20 years: "They now have the right to exist."&lt;br /&gt;&lt;br /&gt;A valuer by profession, he goes even further to say the JMBs and MCs should also be registered. Registering these owner bodies would offer a safety net to individual unit owners, he explains: "Those who serve in the (executive) committees have a responsibility for the (financial) performance of the JMBs and MCs. The Association requires a majority owner support in appealing for the reduction of the rates. So far, the Municipal has not justified as to why the rates are much lower for landed properties whilst higher for individual apartment units which are much smaller and compact in size.&lt;br /&gt;&lt;br /&gt;Scenario one, assuming the calculation is based on the three football fields of land that the total building structure occupies (including compound) and is divided by 1068 or more units (including shops) then a further reduction should be considered as the area of assessment. Overheard the culprit’s comments after removing his vehicle back to the rectangular spot but this time with the handbrake on!!! Man, he was obstructing a vehicle properly parked from exiting out of the proper parking spot. The person had no choice but to push the vehicle slightly away to enable the maneuver.
